Don’t restrict Yasin Malik’s movement; HC to puppet regime

In occupied Kashmir, the High Court has directed the puppet authorities not to restrict the free movement of Jammu and Kashmir Liberation Font Chairman, Muhammad Yasin Malik.

Hearing a petition filed by Muhammad Yasin Malik, a bench of Justice Muzaffar Hussain Attar directed the authorities to follow the provisions of law with regard to the movement of the petitioner.

“The respondents (authorities) however, will not be prevented from proceeding in accordance with law if they feel that any action in terms of law is required to be taken,” the court said, asking the authorities to inform the court if Yasin Malik was put under surveillance, if so for what reason. The directions followed after Yasin Malik’s counsel, Mian Abdul Qayoom, submitted that the regime without any reason breaches the right of personal liberty of the petitioner guaranteed under law.

“Wherever he (Yasin Malik) goes, he is followed by police personnel. As and when the petitioner goes to hospital for getting himself treated, police personnel follow him,” Mian Qayoom informed the court.

He submitted that without any legal justification, the JKLF Chief is being kept under surveillance by the police. The respondents, he argued, have no authority to impede the liberty of the petitioner.

Yasin Malik has approached the court seeking directions not to cause any kind of interference with his right to free movement and not to keep any police personnel for his surveillance outside his residence. He also sought directions that no policeman should follow him, on motorcycle or on any other conveyance, while he is travelling from one place to another.

The puppet administration has been directed to file objections to the petition by the next week.
